Nigerian Hungarian Singer Faces Libel Charge, Risks Jail Term

The Budapest Prosecutor’s Investigating Office has brought an action for libel against a Nigerian
singer whose interview with Bombagyár On-line TV sparked controversy in Hungary early
February.
Lapite Oludayo known as Fekete Páko faces three years
imprisonment if found guilty.
Dr. Gabriella Skoda, Spokesperson for the Prosecutor’s
office, said that the Hungarian Criminal Code clearly
stipulates three years imprisonment for anyone found guilty
of libel, adding that there are other possible punishments
like “fine or community service”.
In February 2008, Olapite, a Nigerian born who sings in
Hungarian, had lodged a complaint against some ‘unknown
people’ including Polgár Tamas known as Tomcat, the
editor of Bombagyár TV in which Lapite alleged that he
was forced to salute Adolf Hitler and Szálasi Ferenc in a
video clip interview. Lapite also claimed that the crew
forced him to caste aspersions on the Jews and Gypsies.
“I was under duress,” Lapite had said in defence of his utterances in February which angered
many people including Africans around the world.
In a counter charge however, Pólgar also accused Lapite of false accusation and defamation. The
case instituted against Polgár by Lapite was dismissed by the police because of “lack of crime”,
while investigation in the libel case against Lapite continues until 3 July. The time for the
investigation, according to Dr. Skoda, could be prolonged by the Prosecutor’s office.
Although Dr. Skoda explained further that saluting Hitler and Salasi both of whom killed many
people in Germany and Hungary respectively is not an offence, the Nigerian Union, Hungary
fearing possible attack had to issue a statement on behalf of Nigerians dissociating them from
Lapite’s “rash” pronouncement.
Asked to comment on the fact that his case against Polgár was dismissed by the police, Lapite said
that he still believed in the system. "I think the police was not convinced enough that I was forced
in the video but I am counting on the evidence in a news story in which Tomcat bared his mind to
kill me".
Lapite further explained that he did not know what the outcome of the case would be but satisfied
with the evidence he tendered to the prosecutor office. "I cut out the clip of a story in which he
(Tomcat) asserted his intention to get rid of me and gave it to the prosecutor".
In his own reaction, Pólgar said: "When I was cited to the public prosecutor, he told me that they
changed my charge of defamation against Lapite to false accusation. Yes, we, the Bombagyár
crew are now the plaintiff. I and "Molnargoreny" have been questioned so far".
Meanwhile, a source close to Fekete Páko said that the singer has kept a low profile since TV2
and RTL Klub stopped featuring him. Before the controversial interview, TV2 had planned to
feature Olapite in a reality show titled, "Fekete Páko Babysitter". The show which could have
been aired in March 2008 and possibly could have furthered Lapite’s career has since been
cancelled.
