COMANDCLEM CELEBRATES INVENTION WITH A RALLY
On Tuesday, people came from all walks of life to celebrate Comamndclem’s invention
of Anti-Corrosive Special Paint for QIT (Transteel Blue, White Enamel Q. A. D.) with a
rally. The invention is listed 184th in the world by International Agency for Intellectual
property and was invented by a Nigerian, King (Dr.) C.J.A. Uwemedimo, making him the
first Nigerian and first African to be recognised by the world body.

The celebration rally kicked off at  Bar Beach, Victoria Island and proceeded to NTA,
American Embassy, British High Commission, Germany Embassy, Italia and Russian
Embassies with Nigerian Flag. The rally was led by Dr. Mike Uyi, a Human Right Activist
based in England.

The Anti-Corrosive Special Paint for QIT (Transteel Blue, White Enamel Q. A. D.) the
first and only enabling chemical that makes oil exploration possible and easier globally,
especially here in Nigeria where corrosion menace pervades is the brainchild of King
Clement Uwemedimo who invented it for Mobil Producing Nigeria Unlimited in 1980 to
protect their offshore oil pipelines and agreement was reached to pay the inventor $2
dollars per barrel of all oil production but breached the agreement.

Mobil Producing Nigeria Unlimited challenged Comandclem/Prof Uwemedimo in  court
over the owner of the invention but the Court of Appeal, Calabar judicial division
presided over by Justice kumai Bayang Akaahs (JCA), delivered the unnanimous final
judgment on December 8, 2009 on the much celebrated case acknowledged and
recognized the expertise, efficiency and proficiency of Prof. Uwemedimo which actually
reflected in his invention of the Anti-Corrosive Special Paint.

The pulsating judgment that has sapped abundant energies, resources and time from
both parties whose conclusion reads partly thus, “I wish to say straightaway that having
applied for the patent and the Patent Certificate No. RP 13522 was issued (Exh. 2)
Comandclem Nigeria Limited became the registered Patentee in the INVENTION called
Anti-Corrosive Special Paint for QIT (Transteel Blue, White Enamel Q. A. D.) with effect
from 5/8/99. The right to the patent in the invention will reside in the appellants who are
the STATUTORY INVENTOR. Any infringement by the respondents (Mobil) or any
other person will be actionable at the instance of the appellants (King
Uwemedimo/CCNL) starting from 5/8/99”; finally marked end of the protracted
contention over the true and statutory ownership of the invention as the Court
unequivocally declared King Uwemedimo as the undisputed True and Statutory
Inventor of the Anti-Corrosive Special Paint for Q.I.T., White Enamel, Transteel Blue-
Quick Air Dry.

The groundbreaking judgment that gave King Uwemedimo/CCNL and his valued
patentees worldwide a landmark and enviable victory who held the Patent Certificate
RP 13522 dated 5th August 1999.

It would be recalled that Prof. Uwemedimo/CCNL has dragged MPN to the Appeal Court
against the ruling of Hon. Justice Gladys Olotu of the Federal High Court, Uyo, Akwa
Ibom State, South-South, Nigeria which was delivered on November 28, 2008 in order
to seek legal redress on the perpetual usurping and blatant infringement of his
intellectual property and enforce payment of his entitled ROYALTIES that have
accrued into several billions of dollars. The case was originally began as Suit No.
FHC/CA/CS/22/2000.

The apprehensive nerves of the patentees who have besieged the court hall to the
brim on that day finally calmed down immediately the case file CA/C/15/2009 that
concerned them was announced by the Court Clerk. Justice Akaahs before going to
read the anticipated judgement, had earlier tendered an unreserved apology as
regards their inability to sit and deliver all judgements slated for December 2, 2009.

The reason was premised on the valedictory service organized in honour of the
outgoing President of the Appellate Court in Nigeria, Justice Umar Abdullahi. He
admitted that the  send-off bash compellled and attracted all of them to converge in
Abuja and bid the retiring honourable justice a befitting farewell.


However, the monetary aspect of the legal tussle was not decided on that day but the
Appellate Court wisely implored King Uwemedimo/CCNL to proceed to the Supreme
Court and have that settled there “since the Apex Court of the land constitutionally has
the final say on all legal and judicial matters (sic). There and then, the exact amount
being owed King Uwemedimo and payment mode would be finalized.

The Appellate Court equally said that King Uwemdimo/CCNL should not start claiming
of their ROYALTIES  from 1980 when the invention was done but from 5th August 1999
when the Patent Certifcate RP 13522 was granted to them.

Commenting on the judgment, the leading counsel to King Uwemedimo/CCNL, Dr.‘Tony
Ukam, OON, thanked the three distinguished judges but said he would have wished the
court settled the monetary aspect as well since it was a crucial part of the prayers
brought before the honourable Appellate Court. He said, “You see, we got 70% of the
victory, whilst Mobil harvested an EMPTY VICTORY. Justice Olotu rendered us
persona non grata, so we went on appeal on 4 major issues:

v        Justice Olotu held that the patent does not belong to us! This gave us away as
touts, fraudsters, etc., that’s why anybody could wake upfrom slumber to call us 419.
Fortunately, the Court of Appeal has declared on 8/12/09 that we are the true and
statutory inventor of the Patent-Mobil Blue Enamelpaint. This Declaration is
fundamental because you can only claim when you are the owner.

v        Secondly, Justice Olotu declared that our case is statute barred (i.e sour) and
that the Hon. Justice Chukwumah – Eneh judgment’s on the issue was per incuriam (i.e
made in passing or side talk). Fortunately, the Court of Appeal reversed it and held
that it was Ratio decidendi (i.e Real Judgment).

v        Thirdly, Justice Olotu held that our case is outrageous and against public policy,
but the Court of Appeal disagreed with Justice Olotu and upheld my argument in the
Appellants’ brief that the case is not against public policy.
In all, since three out of four things were granted to us, according to our Appellant’s
brief, then we are the VICTORS.

The true and statutory inventor while reacting, said, “I’m happy over the judgement for
the Court to have finally recognized me as the true and statutory inventor of the Anti-
Corrosive Special Paint which Mobil at a point said they were part owners, the real
owners, commissioned me and does not even know me from Adam”. He told the
teeming patentees judgment not to worry as he would take the judgment to UK where
culture of invention is high and inventor being rewarded commensurately. There, he
would secure Payment Order and enforcement from the Head of the World Agency for
Intelelctual Property, the Supreme Agency that ensures “The person who sows reaps”
when it comes to intellectual rights by virtue of invention and innovation.
